Terms of Service

This page mirrors the in-app Terms of Service in the Que mobile app.

1. Overview

Que is a platform for queue management, social interaction, marketplace discovery, and business services. By using Que, you agree to these Terms of Service. If you do not agree, do not use the app.

3. Accounts

You are responsible for your account and for activity under it. Guest accounts may be limited and may not be recoverable in the same way as full accounts. You must be at least 13 years old to use Que.

4. Queues and real-world interaction

Que facilitates real-world coordination. We do not guarantee timing, availability, staffing, or outcomes. Businesses control their own queues and service. Users and businesses are solely responsible for their interactions and agreements. Queue data may be delayed or incomplete; do not rely on the app as a sole guarantee of wait time or arrival.

5. Marketplace

Que does not process marketplace payments in the app in this version. Transactions and meetups occur directly between users at their own risk. You are responsible for the accuracy and legality of listings. We may remove listings or restrict accounts where we believe there is a violation or safety risk. Choose public places for meetups and exercise judgment; Que is not responsible for user-to-user meetings or disputes.

5.1 Prohibited listings

You may not use Marketplace for illegal items, weapons, drugs, counterfeit or stolen goods, or other listings that violate applicable law or our policies.

5.2 Marketplace meetups and location suggestions

If you use Que marketplace meetup features, Que may use location information, listing coordinates, participant-provided coordinates, and third-party mapping, routing, or place-data services to suggest public meetup locations for accepted offers. Suggestions are provided for convenience only and do not guarantee safety, suitability, legality, availability, business hours, public access, or accuracy.

5.3 Confirmed meetup sharing

When a meetup is suggested or confirmed, Que may store and display selected meetup location details (such as place name, address, and coordinates) to participants in that accepted transaction. Meetup details may remain associated with the transaction for operations, support, safety, fraud prevention, dispute handling, and legal compliance.

5.4 Third-party maps and directions

Que may allow you to open a confirmed meetup in a third-party maps or directions app. When you do so, you leave Que and use a third-party service governed by that provider's own terms and privacy practices. Que is not responsible for availability, routing, place accuracy, or third-party policies.

5.5 Marketplace safety and user conduct

Marketplace meetup features must only be used for lawful transactions and lawful public meetup arrangements. You must not use Que for prohibited-item transactions, fraud, harassment, threats, stalking, impersonation, or coercive off-platform conduct. We may restrict, suspend, remove, or report accounts, listings, offers, or transactions that violate these rules.

5.6 Marketplace eligibility

Marketplace meetup features are intended only for users who are legally permitted to enter the related transaction and arrange in-person exchanges in their jurisdiction. Que may limit or disable meetup features for certain ages, account states, or jurisdictions.

6. Payments

Business subscriptions and certain purchases may be processed by third-party providers (for example Stripe) and may be completed outside the app or through flows they provide. Apple Pay or similar methods may be offered for eligible services when configured. We do not store full payment card numbers. Third-party providers are responsible for their handling of payment data under their terms. Que is not liable for third-party payment failures or disputes.

7. User content and media rights

7.1 User Content Ownership

You retain ownership of photos, videos, audio, captions, listings, profile images, business images, event images, queue media, and other content you upload. By uploading content, you grant Que a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, process, resize, transcode, compress, distribute, and show that content only as needed to operate, improve, moderate, promote, and provide the Que platform.

7.2 User Responsibility

You represent and warrant that you own the uploaded media, or you have all necessary rights, licenses, permissions, and releases to upload and share it. You may not upload content that infringes copyright, trademark, privacy rights, publicity rights, or any third-party rights.

7.3 Prohibited Media

You may not upload copyrighted music, videos, photos, logos, artwork, clips, or recordings without permission; stolen or scraped media; impersonation content; private images or videos of others without consent; or media that violates app policies, law, or platform rules.

7.4 Music and Audio

You are responsible for ensuring any music, sound, voice recording, or audio included in uploaded content is original, licensed, royalty-free with proper rights, in the public domain, or otherwise legally authorized for your use. Que does not grant users rights to third-party music or audio.

7.5 Business, event, and marketplace media

For business profiles, events, queues, marketplace listings, and promotions, you must only use media you have rights to use commercially when applicable. Businesses and event hosts are responsible for logos, brand assets, promotional images, venue photos, flyers, product photos, and advertising materials they upload.

7.6 Moderation and removal

Que may remove, restrict, disable, or hide any content believed to violate copyright, intellectual property rights, privacy rights, platform policies, or law. Que may suspend or terminate accounts that repeatedly violate copyright or media rules.

7.7 Copyright complaints and counter-notices

To submit a copyright complaint, provide: (a) copyright owner name, (b) contact email, (c) description of the copyrighted work, (d) URL or location of allegedly infringing content, (e) good-faith statement, (f) accuracy statement, and (g) electronic signature. If you believe your content was removed by mistake, a counter-notice may include your name and contact, removed content identification, a statement under penalty of perjury that removal was a mistake or misidentification, consent to jurisdiction if applicable, and your electronic signature.

7.8 App Store and platform safety

Que is not responsible for licensing user-uploaded third-party media. Users are responsible for rights clearance before uploading or publishing content. Que may remove reported or suspected infringing media.

7.9 YouTube Embedded Content

Que may allow users to share or display YouTube videos through YouTube's embedded player or related YouTube services. YouTube videos are hosted by YouTube, not Que. Que does not own, control, download, re-upload, modify, or separately license YouTube video content shown through embedded YouTube players.

Your use of YouTube content is subject to YouTube's Terms of Service, Community Guidelines, Copyright Policies, and any applicable YouTube API Services Terms. By viewing or interacting with embedded YouTube content in Que, you may also be interacting with YouTube's services.

You may not use Que to bypass YouTube restrictions, remove YouTube branding, hide YouTube controls in a prohibited way, scrape, download, re-upload, or redistribute YouTube content unless you have the legal right to do so. If a YouTube video is removed, restricted, made private, disabled for embedding, age-restricted, region-restricted, or otherwise unavailable by YouTube or the video owner, Que may not be able to display it.

Que is not responsible for copyright claims, availability, ads, recommendations, playback restrictions, or policies controlled by YouTube. Sharing a YouTube link or embed does not give you ownership of that video. Do not download, screen-record, copy, re-upload, or repost YouTube videos into Que unless you own the video or have permission from the rights holder.

8. Messaging and calls

You must use messaging and voice or video features lawfully and respectfully. Blocking and reporting tools are available where the product supports them. We are not responsible for misconduct between users; use those tools and exercise judgment.

8.1 Private conversation security mode

Que may use different security modes for different product surfaces. Public or broadly visible product content (such as feeds, public queues, and marketplace listings) is generally server-readable so we can operate search, moderation, ranking, abuse prevention, and delivery features. For eligible private conversation surfaces, Que may enable end-to-end encrypted delivery where only conversation participants can decrypt content on their devices. End-to-end encryption scope, availability, and compatibility may vary by thread type, device, and app version.

8.2 Notification previews for private threads

For threads using end-to-end encrypted delivery, push notifications may use generic text (for example, "New message") instead of message previews.

9. Location use

Location is used for queues, maps, and discovery when you grant permission and use relevant features. In this version, location collection is tied to active use of the app (foreground), not continuous background tracking. You can revoke permission in device settings.

10. Prohibited conduct

You agree not to manipulate queues unfairly, harass others, commit fraud, abuse marketplace or social features, impersonate others, interfere with the service, or violate applicable law.

11. Termination

We may suspend or terminate accounts for violations of these Terms, illegal activity, risk to others, or abuse of the platform. You may delete your account where the product provides that option.

12. Disclaimer

Que is provided "as is" to the fullest extent permitted by law. We do not warrant uninterrupted or error-free operation. We are not responsible for user interactions, marketplace outcomes, missed services, or business decisions.

13. Limitation of liability

To the maximum extent permitted by law, Que, Black Ridge Enterprises LLC, and their operators are not liable for indirect, incidental, special, consequential, or punitive damages, loss of profits or data, or disputes between users. Some jurisdictions do not allow certain limitations; in those cases our liability is limited to the fullest extent permitted.

13.1 No safety guarantee for meetup activity

Marketplace and meetup features are tools only. Que does not guarantee the identity, honesty, conduct, payment, attendance, or safety of any user or meetup. To the fullest extent permitted by law, Que is not liable for losses, injuries, disputes, theft, fraud, property damage, bodily injury, or other harm arising from marketplace activity, in-person exchanges, meetup suggestions, or use of third-party maps, routing, and place-data services.

14. Changes

We may update these Terms at any time. We will post updates in the app and update the "Last updated" date. Continued use after changes means you accept the updated Terms, to the extent permitted by law.
